The existing tenancy agreement for Council
Housing tenants was reviewed during 2021 and a new proposed
agreement has been produced that is easier to understand and
use,
reflects best practice, and meets our current legal and regulatory
obligations.
Under the Housing Act 1985 paragraphs 102 and 103, landlords are
required to consult their tenants on any variations to the terms
and conditions of their tenancy agreement.
Letters were sent to all current Council tenants on 5 November 2021
advising them of our intention to vary their tenancy agreement. In
addition, tenants were sent a full list of all the proposed changes
and the consultation ran for 4 weeks from 8 November 2021 to 6
December 2021.

That the Group Director of Operations, in
consultation with the Cabinet Member with the Health and Housing
Portfolio, approves the new Tenancy Agreement and the recommended
amendments from the consultation exercise.
Following approval, a notice of variation will then be sent to all
current Council tenants.
Reasons for the Decision
The existing tenancy agreement for Council tenants has been in
place for a number of years and is no longer fit for purpose.
A number of the conditions no longer apply and the existing tenancy
agreement does not reflect current practices and legislation.
There is a risk therefore that the existing tenancy agreement could
no longer be enforceable in law.
