Application for Premises Licence

Report of the Group Director of Services

Minutes:

The Group Director of Services submitted a report (previously circulated) to give consideration to an application for a Premises Licence, following representations made by the Fire Service, as a responsible authority, based on the public safety objective being undermined.

 

Present at the meeting were Colin Dobson, Licensing Manager; Brian Murray, Assistant Licensing Manager; Bethany Symonds, Lawyer; David Welsh, Business Fire Safety Officer; and the applicant, Lavinder Kumar.

 

The Licensing Manager introduced the application for a Premises Licence, and Members then listened carefully to the representation made by the Business Fire Safety Officer on the grounds of public safety. Members were informed that works undertaken were not in line with Fire Safety Regulations, and that the Fire Risk Assessment contained 16 Action Points which needed to be complied with to bring the premises up to standard. It was also noted that the Fire Detection System should be interlinked with the flat above.

 

Members listened to the representations made by the applicant in relation to action taken to address the points raised above, however it was recognised that these actions remained outstanding.

 

The Sub-Committee considered the views in accordance with guidance issued under Section 182 of the Licensing Act 2003 and in accordance with the relevant sections of the Council’s Licensing Policy; Section 10 in relation to public safety.

 

After careful consideration Members agreed that the application be rejected, in accordance with section 18(4)(d) of the Licensing Act 2003, as the fire safety requirements had not been fully complied with.

 

RESOLVED – That the Application for a Premises Licence be rejected.
